Notaries are an integral part of the Curaçao legal system. A notary is a public official and makes agreements and statements legally valid by recording them in a notarial deed. A (junior) civil-law notary is an expert in the laws and regulations of real estate law, personal and family law and corporate law. A civil-law notary is an impartial expert who represents the interests of all those involved in drawing up a notarial deed.
A notarial deed is the result of a complex process in which the civil-law notary advises his client (s) on the legal, fiscal and financial implications of the transaction and the legal means by which the client (s) can best be achieved. After a notarial deed has been signed by a notary public, the date of the deed is established to everyone and everyone can be confident that the deed has been signed by those listed as signatories.
The notarial deed is primarily intended to provide great legal certainty and provides compelling evidence. In the law of evidence, the notarial deed therefore has a considerably stronger position than a non-notarial deed (a private deed).
